Terms of Service

These Terms of Service ("Terms") govern your use of the Rescue Radar mobile app (the "App"), operated by Steeplechase Industries, doing business as Rescue Radar ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to these Terms. If you don't agree, don't use the App.

1. Not a Medical Device — Read This First

Rescue Radar is a personal tracking and logging tool. It is not a medical device, does not diagnose or treat any condition, and does not provide medical advice. The limits, gauges, and trends shown in the App are based solely on information you enter — they are not a substitute for guidance from a licensed medical professional. Always talk to your doctor about your migraine treatment plan, including any changes based on patterns you notice in the App. If you are experiencing a medical emergency, contact emergency services immediately — do not rely on this App.

2. Eligibility

You must be at least 18 years old to create an account and use the App. By using the App, you represent that you meet this requirement. If you are tracking medication for a family member, dependent, or someone in your care, you (the account holder) remain responsible for that account's use.

3. Your Account

You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Tell us right away at support@migrainerescueradar.com if you suspect unauthorized access. You can delete your account at any time from within the App's settings; see our Privacy Policy for what happens to your data when you do.

4. Subscriptions and Billing

Some features of the App require a paid subscription, purchased and billed through the Apple App Store or Google Play (the "Platform"), not directly by us. The price, duration, and any free trial for your subscription are shown at the time of purchase in the Platform's purchase screen.

• Auto-renewal: subscriptions automatically renew for the same term unless you cancel at least 24 hours before the end of the current period. Your Platform account will be charged for renewal within 24 hours prior to the end of the current period.
• Free trials: if a free trial is offered, any unused portion is forfeited when you purchase a subscription, and you'll be charged at the end of the trial unless you cancel before it ends.
• Cancellation: manage or cancel your subscription through your Apple ID or Google Play account settings — we cannot process cancellations or refunds directly, since we don't handle your payment. Refunds are subject to the Platform's refund policy.
• Price changes: if we change subscription pricing, we'll provide notice as required by the Platform before the change applies to you.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the App, other accounts, or our systems;
• Interfere with or disrupt the App's operation;
• Reverse-engineer or copy the App except as permitted by applicable law.

6. Your Content

You retain ownership of the information you enter into the App (medication logs, notes, imported files, etc.). You grant us a limited license to store, process, and display that information solely to provide the App's features to you, as described in our Privacy Policy. We don't claim ownership of your data.

7. Third-Party Services

The App relies on third-party services (described in our Privacy Policy) to provide features like voice transcription, file import, and subscription management. We aren't responsible for the availability or performance of those third-party services, though we choose providers we believe handle your data responsibly.

8. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that the App will be uninterrupted, error-free, or that any calculation or trend shown will be accurate or complete — you are responsible for verifying medication information against your prescriptions and your doctor's guidance.

9. Limitation of Liability

To the fullest extent permitted by law, Rescue Radar will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or health outcomes, arising from your use of or inability to use the App. Our total liability for any claim relating to the App will not exceed the amount you paid us, if any, in the twelve months before the claim arose.

10. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete your account at any time.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable consumer protection law requires otherwise.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the effective date above and, where appropriate, notify you in the App. Continued use of the App after changes take effect means you accept the updated Terms.
